1. Introduction
Marg Consultancy and Placement Services LLP: WE provides staffing and recruitment services to clients . These terms and conditions govern your use of our services and your engagement with candidates we present to you.
2. Definitions
- Client: The company or organization engaging our services.
- Candidate: The individual referred by us for potential employment with the Client.
- Engagement: The hiring, employment, or contractual relationship formed between the Client and the Candidate.
3. Service Scope
- We provide recruitment and staffing services based on the requirements provided by the Client.
- We will source, screen, and present candidates that meet the agreed-upon criteria.
- Final selection and hiring decisions are solely at the discretion of the Client.
4. Candidate Introduction
- All candidates introduced by us are considered proprietary for a period of 12 months from the date of introduction.
- If a Client hires a candidate introduced by us within this period, the Client agrees to pay the applicable fees.
5. Fees and Payment Terms
- Fees for our services will be agreed upon in advance and confirmed in writing.
- Payment is due within 30 days of the candidate’s start date unless otherwise agreed in writing.
- Late payments will incur interest at a rate of 1.5% per month.
6. Candidate Engagement
- The Client agrees to notify us immediately upon the engagement of a candidate introduced by us.
- Any employment or contractual offer made to a candidate must be communicated to us promptly.
7. Guarantee and Replacement
- If a candidate terminates their employment or is terminated by the Client within 90 days of their start date, we will provide a replacement candidate at no additional cost, subject to availability and the Client’s adherence to these terms and conditions.
- The guarantee does not apply if the Client has overdue payments.
8. Confidentiality
- Both parties agree to keep all shared information confidential and not disclose it to third parties without prior consent.
- This includes, but is not limited to, candidate resumes, interview feedback, and contractual terms.
9. Non-Solicitation
- The Client agrees not to solicit or hire any of our employees or consultants involved in providing services to the Client for a period of 12 months following the last engagement.
10. Liability
- We will exercise reasonable care in selecting and presenting candidates. However, we do not guarantee the suitability or performance of any candidate.
- We are not liable for any loss, damage, or expense incurred by the Client arising from the engagement of a candidate.
11. Termination
- Either party may terminate the service agreement with 30 days’ written notice.
- In the event of termination, the Client will be responsible for all fees due for services rendered up to the date of termination.
12. Governing Law
- These terms and conditions shall be governed by and construed in accordance with the laws of India.
- Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in [Your City, State].
13. Amendments
- We reserve the right to amend these terms and conditions at any time. Any changes will be communicated to the Client in writing and will be effective immediately upon acceptance by the Client.
14. Acceptance of Terms
